Our submission in response to ASIC’s Consultation Paper 381: Updates to INFO 225: Digital assets: Financial products and services

Our submission addresses ASIC’s proposed updates to INFO 225 to provide guidance on how current financial product definitions apply to digital assets. It includes five main recommendations and provides views on several issues raised in the Consultation Paper.

Our key recommendations

  1. Establishing a dedicated workstream to iteratively resolve regulatory issues in Real-World Asset (RWA) tokenisation
  2. Comprehensive mapping of tokenised RWAs from different tokenisation models to existing legislation
  3. Regulatory reforms to address barriers to RWA tokens and unintended classifications identified in Recommendation 2
  4. Targeted regulatory relief to bridge the misalignment between existing Financial Market Infrastructure (FMI) licences and the unique structure of digital FMI.
  5. Developing a fit-for-purpose licensing regime for digital FMI.
